HC rejects rule on ex-SC judge’s bail

The High Court on Tuesday rejected a rule issued on anticipatory bail to former judge of the Appellate Division Justice Md Zainul Abedin in connection with a notice issued in 2010 by Anti-Corruption Commission (ACC) seeking his bank statement.

An HC bench led by Justice Md Nazrul Islam Talukder and Justice Dr K M Hafizul Alam passed the order.

Now, his bail granted by HC will be cancelled following the order.

Barrister Moinul Hossain stood for Md Zainul, Khurshid Alam Khan for the ACC and deputy attorney generals Rona Nahrin and A K M Amin Uddin for the state.

A K M Amin Uddin said that there is no example of getting advance bail in this type of case. “Chaos will be created if there is any chance for taking bail before filing of a case,” he added.

The court also said the accused mentioned an example of Pakistan. However, the example of Pakistan will not be accepted in this country, he added.

Earlier on July 10 last year, the HC granted anticipatory bail to Zainul Abedin in connection with the ACC notice and also issued a rule asking the government and ACC to explain why Justice Zainul should not be granted a permanent bail in connection with the notice.

The ACC in July 2010 sent a notice to Justice Zainul Abedin asking him to submit his wealth statement to the national anti-graft body.

On July 25, he filed a writ with the High Court challenging the legality of the notice which was rejected later.

Later on October 25, the ACC issued another notice for submitting the wealth info. 

Justice Zainul Abedin submitted his wealth information to the ACC on November 3.

In 2017, the ACC asked for his explanation and he submitted it  

However, a report was published in June on this regard. Being feared of arrest and harassment, he sought anticipatory bail to HC.

Later, the HC granted his bail until the final investigation and issued the rule.
