Executive magistrates can run mobile courts for 2 weeks more: SC

The Appellate Division of the Supreme Court extended two weeks the stay on a High Court order that declared the operation of mobile courts by the executive magistrates illegal.

The lawyers said the executive magistrate can operate mobile courts during this time.

A seven-member bench of the Appellate Division led by chief justice Surendra Kumar Sinha adjourned the hearing following a plea by the government.

After completing hearing of three writs, the High Court declared illegal the operation of mobile courts by the executive magistrates.

Following a stay plea by the state on the HC verdict, the chamber judge postponed the effectiveness of HC verdict till 18 May and sent it to the regular bench for hearing.

The matter was placed before the court for hearing on 21 May.

The court stayed the hearing till 2 July. The court adjourned for two weeks on Tuesday.

On behalf of the state, attorney general Mahbubey Alam sought time for four weeks. The court granted two weeks. Lawyer Hasan MS Azim stood for the writ petitioner.
