Kidney donation outside close relatives for emotional reason valid

On Thursday, the High Court said people outside close relatives could emotionally but not for commercial purposes donate body organs, including kidney, to patients.

It also requested the Health Services and Health and Family Welfare Ministry's Directorate-General to amend the law within six months.

Justice Moyeenul Islam Chowdhury's HC bench and Justice Khandaker Diliruzzaman came up with the decision after disposing of a regulation that had been released earlier after a written request.

The attorney ZI Khan Panna represented Ain O Salish Kendra and the Deputy Attorney General Saifuddin Khaled moved to the ministry.

Nevertheless, the court barred the trade in organs and ordered every hospital to create a certifying body to investigate if psychological donation is being practiced when donating organs, including the kidney.

On November 21, the HC, after hearing the law seeking clarification as to why three parts of the 1999 Organ Donation Act should not be declared illegal, scheduled December 5 for delivering its judgment.

The rule was released on August 24, 2017 after Fatema Johora's hearing of a written request.

Johora gave her ailing daughter Fahmida a kidney in 2015, but her kidney was still unsuccessful.

Although the donor was willing, her daughter was prevented from getting a fresh kidney by legal complications.
